Planning Permission? Ok, hope this doesn't come across as too complicated...! The house...
Ok, hope this doesn't come across as too complicated...! The house we live in is split into two flats, near us living on the bottom floor. We own a long, narrow courtyard that open up into upstairs garden. To gain access to this garden, the top flat have a steel fire escape that descends into our courtyard (they later have right of access)... It stands aprox 12ft soaring at the mo.
They have of late told me that they are going to take down the steel staircase and replace it beside a wooden structure that will run down the length of the building (above our courtyard) and later descend into their garden. They will have to support it on massive wooden posts.
They are not 'going to bother' with planning concurrence and have already have the builders in to make a contribution them a quote (without telling us). They are the freeholders (we are leaseholders) so as such they enjoy the right to do what they want. But will they need planning blessing? If they don't is there anything we can do roughly it?
Answers: They will need planning authority and get building regulations. What use is a wooden staircase within a fire?
Inform the council.
You may wish to permit you local planning enforcement team know (its anonymous) - however they can't do anything to enforce against the building works until they hold commenced. They definatley need planning concurrence as flats have no permitted nouns rights; one would also assume building regs too.
