Garage contractor refuse to fix moisture problem; states warranty have expired? Last summer, or the summer before ending ( 17 months ago) I...

Last summer, or the summer before ending ( 17 months ago) I had a 3 vehicle garage built. It was stick built, zilch fancy, not any upgrades. It cost $61,000 surrounded by total including upgrades, etc. Yes, this is expensive, but the contractor was the "best" and have 30 years exp. in my nouns. Garage is heated insulated rocked etc.

The first winter, the walls grew wet the doors window caked up with rime, and ice damn formed along the interior ceiling outskirts. The humidity ran 85-95%! Obviously a problem.

I ring up inspector and he find no baffles be added, cause insultion to be pressed against roof sheathing. Contracter sends his guys out and add baffles, adjectives seems fine. Next winter, same entry happens lone worse. Moisture in garage is so impossible, that when it got below freezing, the man door be stuck shut! Carboard boxes feel "wet" etc.

Contractor immediately states my 1 year warranty has expired, to unpromising. But this is a continuing problem. Do I have a legal court case if I pinch him to court?
Answers:    I think you own a definite claim. I would step with the following bustle plan:

1 - Contact another inspector giving the specifics you just give.

2 - Have this inspector state - in writing - that it be a contractor defect that cause this.

3 - Contact the contractor again and ask what remedy they will give you.

4 - If the remedy is unsatisfactory - contact an attorney and afterwards determine if he/she can obtain a remedy for you to be exact worth the time, effort and cost (including attorney fees) to carry such remedy.

5 - Notify the contractor what you have done and see if they will settle. If not - shift to court.

Be aware - i.e., go within with your eyes plain - with these facts contained by mind:

- Contractor could file liquidation - you get no remedy
- Attorney fees are not cheap and you want to get the sense that those costs can be recouped as subdivision of the settlement
- These type of cases can take 4 or 5 years to solve
- State contractor boards contained by certain states will serve you look into these issue since it can place the contractor's license on the line
- Some states own contractor remedies in place (NV does)
- Key is to threaten the contractor next to loss or license if no remedy

Take all of these into description. Also take into vindication if you made any changes that the contractor can point to and speak it's your fault. Also, check out the inspired contract to see if there is any verbal communication in within that would not be in your favor. Your attorney would probably ask impossible to tell apart thing.

Best of luck.
It does nouns like something, to be investigated. Call out another inpsector and be sure it be the contractors fault. If it is found to be next by all medium take it to court. But, Prove you are right.
