Question when I rebuild my fence ( which I discern they should pay for) I will need to cut the roots that cause the damage on my property. This will make the tree unsafe. What is my legitimate position as next door does not want me to do anything. As the tree continues to grow the house could be in exposure as well
neighbors are liable if wreck caused is clearly their responsibility. If anything from their house is causing glum effect to you, they are liable and you can first request from them to fix this issue in writing. if it doesnt work contact a lawyer and request full repair + damages We be told Willow was one of the worst trees to have surrounded by your garden for causing subsidence, their roots get everywhere. The best route to kill a tree is to hammer some pieces of copper pipe into it. Can't you do that on your side?
the thing in the order of a willow tree is the roots go looking for water to nurture the tree, they a renound for damaging sewer pipes, if you have a stream at the bottom of the garden the roots will walk all the way to it, they are close to an underground triffid basicly, but saying that in the right place they are an attractive tree, if you cut the roots on your side of the blockade i doubt if you will make the tree unstable, a tree surgeon will offer the best counsel and will probably know a bit about the law to, tree surgeons dont a moment ago cut down trees they maintain them, pruning, caring etc etc Joe,
I assume that you can legally cut anything that is destroying your property as long as its on your side. I would communicate them the exact day I'm cutting, if you own an attorney, best talk to him too, but it would be better if neighbors talked to neighbors, brotherly love bs.

you hold the right to cut the roots if they are on land.and you are right the house could be in danager.form the tree roots. Sounds similar to " war ". Consult your council in first instance, yes, even if you do own the property.
Answers: In most communities ~ neighbors have the right to matter with branches, roots etc encroaching on their sides. However, I intellectual recently that in some states, trees are protected property and the neighbors can find into serious trouble damaging a tree that doesn't belong to them.
So what you do
1) talk to the neighbor first and ask if he would consider removing the tree.You can discuss how it's penchant, damaging the fence, interfering near the roots of your tree, heading for your foundation etc. The objective here is for him to remove the tree in a neighborly vogue without ending up contained by court about it.
2) If your neighbor refuses to do anything ~ the subsequent step is to visit an attorney and get some lawful advice. My guess is that he will encourage you to report a suit against the neighbor to get the tree removed before it ends up cause any more significant damage to your property.
