I have be fighting this rattan for seven years. Digging up my yard. Now that I enjoy had surgery on my knees twice. I can't dig up my patio anymore. Can I sue him. Live in Delaware
I would check with Planning and Zoning surrounded by your fair city first. They will know the regulation and may even help you. Also, check next to the nearest Zoo if you want to control/get rid of the bamboo. Most Zoos grow it to nurture animals, so they are quite knowledgable something like it. Good luck.


Laws differ from state to state ~ where on earth I live, if the encroaching tree or plant is wounding your property, you have the court right to deal beside it anyway you want, as long as you don't damage/kill the stuff on your neighbors property.
Not all states are like peas in a pod however, and in some cases, you can be taken to court for wounding your neighbors shrubbery & trees.

What I would suggest is...
first talk to your neighbor and ask him to win rid of his bamboo ~ explaining the situation that you don't want it surrounded by your yard, and immediately you are not in a position to remove it. If he does not comply, it's time to see an attorney. Until he removes HIS rattan from HIS yard, you won't stop it from coming into yours and I can't see any other means of access to force him to contain it. IMO This is not something you can take to small claims court since you can't put a $$$ effectiveness on this.
Answers:    To the best of my experience if the plants originate on his property you cannot verbs them up however you are able to cut down any parts of the plants that infringe on your property stripe. Hope this helps.
