Contractor responsibility re: asbestos ? I recently have my basement waterproofed and piece of the process...
I recently have my basement waterproofed and piece of the process involved jackhammering up the perimeter of my vault floor. Later I was told (not by the contractor who waterproofed the basement) that the tile on my underground room floor was asbestos, so very soon I'm left next to dust from all that jackhammering adjectives over my basement and a bunch of ragged, partially diluted asbestos tiles still on my floor. Don't contractors have some responsibility for making sure that those kind of tiles are removed in the "correct" passageway before they complete their work? Or is it my fault for "letting" them do the work on asbestos tile that hadn't be remediated? I didn't even know it WAS asbestos tile.it was within when I bought the house.
Answers: Being a flooring installer I have be trained from day one that if existing vinyl must come up, other assume it contains asbestos. By law, individual someone certified in asbestos abatement is permitted to remove asbestos. If you can find a piece of impossible to tell apart tile, perhaps within another room of the house, under the runner, you may be able to find a company surrounded by your area that will trial the piece for asbestos content.
If you have plea to believe that the contractor's negligence has put your family's strength at risk, you may consider contacting an attorney. I do not condone hysteria or careless litigation. HoweverIf my family's strength is endangered by someones lack of judgment I think it is likely to ask that the situation be corrected. It may be that the contractor had determined the tile to be free of asbestos and proceeded contained by a safe and professional carriage.
I had a similar problem, and we have to get <certified asbestos removers> not our contractor. Cost a bundle, but is past the worst and good in a minute. So, I guess the contractor is not responsible. ? Look for some good removers, next to the training certificate, to be precise what the State looks for when they give you a building permit> Good Luck.
